تهدف هذه الدراسة إلى التعرف على حق الدخول والخروج عبر الأراضي الزراعية في مصر إبان العصر الروماني في ضوء الوثائق ‏البردية. إذ أن ثمة شرط في عدد من عقود البيع أو التنازل أو تقسيم الأرض بين الورثة أو عقود إيجار الأراضي، حيث يمنح الطرف ‏الأول الطرف الثاني وورثته وأحفادهم من اليوم المذكور وإلى الأبد، ضمن أمور أخرى، حق الدخول والخروج. وكما هو معروف ‏فإن حق الدخول والخروج هو من الحقوق العينية، التي تفرض قيودا في بعض الحالات على حق الملكية المطلق. ومن هنا فإن الهدف ‏الرئيس للدراسة هو معرفة صيغ حق الدخول والخروج والأحكام العامة والخاصة.‏
The Right of Access and Exit through agricultural lands
in Egypt during Roman Era.‎
Abstract:
This study aims to investigate the right of access and exit through agricultural lands in ‎Egypt ‎during ‎Roman era ‎in the light of papyri. Where there is a clause in a number of contracts ‎of ‎sale, ‎Cession, ‎division of ‎property between heirs, or a lease of land contracts, whereby the ‎first ‎party ‎grants the ‎second party, his heirs, and their descendants from the above mentioned day ‎for all time to come, ‎among other things, the right of access and exit.‎ As well-known, the ‎right of ‎access and exit is one of Rights in rem, Which imposes restrictions in some cases on the right of ‎absolute ownership. Hence, the main goal of the study is to know the formulas for ‎the right of ‎access and exit, as ‎well as the general and special provisions.‎‎
